DELIVERY AND SHIPPING TERMS

1. Scope
This document governs the conditions for the preparation, shipment, and delivery of orders placed through sedajewellery.com, operated by Seda Berberoğlu Utku (hereinafter referred to as "Seller" or "Seda Jewellery").
Sales through the site are exclusively to businesses (B2B / wholesale) acting for commercial purposes and intending to resell. The party placing the order ("Buyer") declares that they have read and accepted these terms by placing an order.
This document is an integral part of the Wholesale Agreement and Sales Policy.

3. Minimum Order Amount
Orders placed through the site are subject to a minimum order amount of 2,000 TL (VAT included). Carts below this amount cannot proceed to the payment step.
4. Order Preparation Time
- Upon confirmation of payment being received by the Seller's account, orders will be prepared and delivered to cargo within 1-2 business days.
- Business days do not include Saturdays, Sundays, official holidays, or administrative holidays announced in advance by the Seller.
- For items out of stock or requiring production, preparation time may be extended; in such cases, the Buyer will be informed via email or phone.
- During peak seasons (e.g., trade fair schedule, before holidays), preparation times may be announced separately on the site.
5. Domestic Delivery
Contracted cargo company: Aras Kargo
- Shipments are delivered to the address provided by the Buyer during the order.
- The average delivery time after delivery to the cargo company is 1-4 business days. This period depends on the cargo company's operations and is not guaranteed by the Seller.
- The cargo tracking number will be shared with the Buyer after the shipment has been handed over to cargo.
5.1. Shipping Fee
For domestic shipments, the shipping cost is borne by the Buyer and is paid to the cargo company upon receipt of the shipment (recipient-paid shipment).
Shipping costs are calculated by comparing the actual weight and volumetric (dimensional) weight of the shipment, and the higher of these values is used. For domestic shipments, dimensional weight calculation is based on Aras Kargo's current tariff, and pricing is entirely subject to the cargo company's tariff.
6. International Delivery (Export)
Shipping is available worldwide.
Delivery term: DAP (Delivered at Place) — Incoterms® 2020
International shipments are carried out through international courier/cargo service providers contracted by the Seller.
6.1. Freight, Customs, and Taxes
- International transport (freight) costs are borne by the Buyer.
- All import duties, customs duties, VAT, customs brokerage fees, storage, order fees, and similar expenses incurred in the country of destination are borne by the Buyer. These costs are not included in the product price or freight; they are collected directly from the Buyer by the courier company or customs authorities.
- The Buyer is solely responsible for ensuring compliance with import regulations in their own country (permits, licenses, product standards, labeling, etc.).
- If the shipment is returned, destroyed, or held due to the Buyer's failure to pay import taxes or clear the shipment from customs, all resulting costs will be borne by the Buyer, and the Seller is not obligated to refund the product price in such cases.
6.2. Volumetric Weight Rule
For international express shipments (UPS, DHL, FedEx, and equivalent carriers), pricing is based on the higher of the actual weight and the volumetric weight.
Volumetric weight (kg) = (Length × Width × Height) ÷ 5000 (measurements are in centimeters)
Example: Even if a parcel with dimensions 40 × 40 × 30 cm has an actual weight of 2 kg, its volumetric weight is (40 × 40 × 30) ÷ 5000 = 9.6 kg, so pricing will be based on approximately 10 kg.
The Buyer can request information on estimated shipping costs from bysedajewellery@gmail.com before ordering.
6.3. Delivery Time
The average delivery time for European countries is 3-5 business days.
This period is an estimated time from the moment the cargo is handed over to the carrier. The time spent in customs is not included in the delivery time and is beyond the Seller's control. Delays caused by the Buyer (e.g., incomplete or incorrect company/VAT information, late payment of import duties, late appointment of a customs broker) will extend this period.
For destinations outside Europe, delivery time varies depending on the country, customs procedures, and the carrier's operations; information can be requested from bysedajewellery@gmail.com before ordering.
6.4. Export Documents
International sales are subject to export regulations. An export invoice and, if necessary, a customs declaration (including ETGB) will be issued with the shipment. The Buyer is obliged to provide complete and accurate company information for invoicing (company name, tax/VAT number, full address, contact details).
7. Address Information and Receipt
- The Buyer is obliged to provide a complete and accurate delivery address. All costs arising from the non-delivery, return, or re-delivery of the shipment due to an incorrect, incomplete, or outdated address will be borne by the Buyer.
- Address change requests must be submitted in writing before the shipment is handed over to the cargo company. Changes after the shipment has been dispatched are not guaranteed.
- For shipments not received during delivery attempts by the cargo company and returned to the Seller, the outbound and return shipping costs will be charged to the Buyer.
8. Obligation to Inspect Upon Delivery — IMPORTANT
The Buyer holds the title of merchant. Therefore, in accordance with Article 23/1-c of the Turkish Commercial Code:
- The package must be inspected in the presence of the cargo officer. Packages that are dented, torn, wet, opened, or have damaged tape should not be accepted, or a damage report should be drawn up by the cargo officer. The Seller is not responsible for damaged shipments accepted without a report.
- Clearly visible defects (missing product, wrong product, broken/damaged product) must be reported to the Seller in writing within 2 (two) days from the delivery date.
- Hidden defects must be reported within 8 (eight) days from the date they are discovered.
Products will be deemed accepted if no notification is made within these periods. For notification procedures and the subsequent process, please refer to the Cancellation and Return Conditions document.
9. Transfer of Risk and Title
The risk of loss or damage to the products passes to the Buyer at the moment the products are delivered to the cargo company. Title to the products passes to the Buyer upon full payment of the order amount to the Seller.
10. Force Majeure
Delivery times do not apply in cases beyond the Seller's reasonable control, such as natural disasters, epidemics, wars, strikes, cyberattacks, customs or airspace closures, operational disruptions of cargo companies, or decisions of official authorities. In such cases, the Seller will inform the Buyer; if delivery is not possible within a reasonable time, either party may cancel the order, and any collected amount will be refunded to the Buyer.
